Any person who violates the provision of this chapter is guilty of a separate offense for each day or portion of a day during which the violation is committed, continued or permitted and each offense is punishable by confiscation and fine not to exceed $200 for each offense. Any material so found and observed by a complainant herein would not be subject to total confiscation unless a hearing is first provided; however, any material may be seized as evidence for any prosecution hereunder.
