For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
APPLICANT. Any person seeking a permit to operate a retail food store or food service establishment and every person to whom a permit has been issued.
CITY. The City of Port Isabel, Texas.
EMPLOYEE. Any individual working in a food service establishment or retail food store, whether paid or unpaid, full-time or part-time, on a temporary or permanent basis, or an independent contractor.
FOOD. Any raw, cooked or processed edible substance, ice, beverage or ingredient used or intended for use or for sale in whole or in part for human consumption.
FOOD SERVICE ESTABLISHMENT. Any place open to the general public or where, for distinct payment, food or drink is prepared or served for human consumption, whether served and consumed on the premises or off the premises. The term includes temporary food service establishments and mobile food units.
HEALTH DEPARTMENT. The Health Department of the city.
HEALTH OFFICER. The person designated by the City Manager to enforce this subchapter and state law relating to food service establishments and retail food stores.
MOBILE FOOD UNIT. A wheeled or vehicle mounted food service establishment designed to be readily moveable. In addition to the requirements of this subchapter, MOBILE FOOD UNITS shall comply with additional ordinance requirements of the city.
PERSON. Any individual, partnership, company, venture, association, trust, estate, foundation, institution, organization, group, governmental subdivision or agency, and any other entity recognized by law as the subject of rights and duties whether operated for profit or not for profit.
PERSON IN CHARGE. The individual present in a food service establishment or retail food store who is the apparent manager or supervisor of the food service establishment or retail food store at the time of inspection or delivery of notice. If no individual is the apparent supervisor, then any employee present is the PERSON IN CHARGE.
RETAIL FOOD STORE. Any establishment where the only food offered for sale to ultimate consumers is that which is intended for off-premises consumption.
ROADSIDE FOOD VENDORS. A person who operates a mobile food store from a temporary location adjacent to a public roadway or highway. A ROADSIDE FOOD VENDOR is classified herein as a retail food store.
TEMPORARY FOOD SERVICE ESTABLISHMENT. A food service establishment that operates at a fixed location for a period of time of not more than 14 consecutive days in conjunction with an event or celebration.
