If a complaint has been filed with the Chairperson under the provisions of this chapter and if the complainant shall have filed with the Secretary for Housing and Urban Development under the provisions of Title VIII, Fair Housing, Civil Rights Act of 1968, Pub. L. No. 90-284, 90th Congress, a similar complaint arising out of the same transaction and if the Secretary shall act on the complaint on the ground that this chapter does not afford rights and remedies substantially equal to those afforded under federal law and that, therefore, the federal proceeding takes precedence over the proceeding under this chapter, then the proceedings under this chapter shall be dismissed.
