The Charter Commission directs that the Charter be voted upon as a whole and that it shall be submitted to the qualified voters of the City of Port Isabel at an election to be held for that purpose on Saturday, January 21, 1984.
Not less than thirty days prior to such election, the City Commission shall cause the City Secretary to mail a copy of this Charter to each qualified voter of the City of Port Isabel as appears from the latest Voter Registration List. If a majority of the qualified voters voting in such election shall vote in favor of the adoption of this Charter, it shall become the Charter of the City of Port Isabel, and after the returns have been canvassed, the same shall be declared adopted and the City Secretary shall file an official copy of the Charter with the records of the City. The Secretary shall furnish the Mayor a copy of said Charter, which copy of the Charter so adopted, authenticated and certified by his signature and the seal of the City, shall be forwarded by the Mayor to the Secretary of State of the State of Texas and shall show the approval of such Charter by majority vote of the qualified voters voting at such election.
Dear Mr. Mayor:
We submit herewith the original copy of a Home Rule Charter for the City of Port Isabel as drafted by the Home Rule Charter Commission duly elected.
The Home Rule Charter Committee in compliance with the applicable law of the State of Texas, has designated January 21, 1984, as the date on which this Home Rule Charter is to be submitted to the qualified voters for adoption or rejection, said date being between 40 and 90 days after the date on which the Home Rule Charter Commission completed work on the Charter.
Your attention is called to Article 1167, V.A.C.S., which directs that not less than 30 days prior to the date designated for submission of the Charter for adoption or rejection, the City Secretary shall mail a copy of the Charter to each qualified voter of the City of Port Isabel.
This Home Rule Charter creates a City-Manager form of government with a Commission composed of a Mayor and four (4) Commissioners. It retains all the powers now exercisable by the City under the Constitution and the Statutes of the State of Texas, adds thereto certain powers not heretofore granted to the City, and in general clarifies the means by which powers of the City are exercised.
We recommend this Charter to the citizens of Port Isabel and recommend its adoption. It is our belief that it will permit our City Government to operate more effectively and satisfactory to the best interests of all citizens.
Our appreciation is extended to you and other members of the City Commission, as well as to State Officials and the League of Texas Municipalities in Austin, Texas, who have assisted us in the work of drafting this Charter.
We ask that a copy of this letter of transmittal be sent with a copy of the proposed Charter when it is mailed to all voters.
