§ 100.36 RULES AND REGULATIONS.
   (A)   Boat owners or operators shall sign an agreement on a form furnished by the city with the following conditions set forth:
      (1)   The city shall not be held responsible for any accident or injury to owners, operators, crew-members or guests while the boat is docked at the city dock;
      (2)   The city shall not be held responsible for any damage incurred by the boat while docked at the city dock;
      (3)   Owners or operators agree to pay for any and all damage caused to the city dock; and
      (4)   In the event that the boat should sink at the city dock, the owner or operator shall raise the boat within ten days, and remove it from the city dock.
   (B)   No commercial boat shall be allowed to dock or operate at the city dock except in an emergency. A commercial boat is defined, as one that is engaged in carrying freight for hire, crew boats, work boats, shrimp boats, bay shrimp boats or crab boats.
   (C)   No major engine repairs or hull work shall be performed on any boat docked at the city dock. Minor engine repairs and topside painting may be performed.
   (D)   At all times a 50-foot length of dock space shall be reserved for any boat that may need emergency docking.
   (E)   Fees and making application shall be disregarded during a hurricane alert. Boats may dock in any available space until hurricane or alert has passed.
