The Code hereby adopted is amended and changed in the following respects:
(A) Section 17, Article 1, is hereby amended for the purpose of adding thereto the following subsection:
Section 17. Permits.
d. All permits required or authorized by this code shall be issued by the Fire Marshal of the City of Port Isabel and no permit shall be issued for a term of more than one year. The Fire Marshal may, at his or her discretion, issue permits for less than the one-year period. No fees shall be charged for any permits unless and until the governing body of this city adopts a schedule of fees to be charged and prescribes the amount and manner of payment of the fees by resolution of the governing body of the city without amendment of this ordinance for that purpose.
(B) Subsection b of § 53, Article 5, is hereby amended to hereafter read as follows:
Section 53. General Requirements.
b. The storage of explosives and blasting agents within the corporate limits of the City of Port Isabel is hereby prohibited, except for wholesale and retail stocks of small arms ammunition, fuses, lighters, fuse igniters and safety fuses (not including cordeau detonant fuses) in quantities involving less than 500 pounds of explosive material; and explosive-actuated power devices, when employed in construction operations in highly populated areas, in quantities involving less than 50 pounds of explosive material.
(C) Section 151, Article 15 is hereby amended to hereafter read as follows:
Section 151. Permit Required.
No place of assembly as defined in § 150b shall be maintained, operated or used as such without a permit, except that no permit, shall be required for any place of assembly used solely as a place of religious worship or solely for educational purposes.
(D) Subsection b of § 172, Article 17, is hereby amended to hereafter read as follows:
Section 172. Permit Required for Welding or Cutting.
b. A permit shall not be required of any company, corporation, copartnership or owner-operator:
(1) Where the welding or cutting is performed in areas within the City of Port Isabel zoned L-l (Light Industrial) or H-l (Heavy Industrial) under the zoning regulations of the City of Port Isabel; or
(2) Having an approved permit system established for control of the fire hazards involved as certified by the Fire Marshal.
