(A) The city shall be responsible for the general care and maintenance of the cemetery. The care and maintenance shall include:
(1) Watering and cutting of grass at reasonable intervals;
(2) Raking and cleaning at reasonable intervals;
(3) Reseeding and resodding;
(4) Maintaining the proper placement of markers;
(5) Preservation of walls, walkways, fences, shrubs; and
(6) Maintenance of plumbing, drainage, lighting and electrical systems.
(B) The city shall not be responsible for damage to a particular grave caused by an act of God, theft, vandalism, malicious mischief, explosion, accident, terrorism, riot or action of any military or civil authority.
(C) The cemetery shall be open for visitation during daylight hours between the time of sunrise and sunset.
(D) The city reserves the right to enlarge, reduce, replat or change the boundaries and grade of the cemetery, including the right to change the location of roads, walks and parking and the right to change or alter pipelines, gutters, watering systems, drainage, lighting and electrical systems.
