If the officer whose removal is sought does not resign within five days after the certification to the Commission that the petition is proper, then it shall be the duty of the City Commission to order an election and fix a date for holding such recall election, the date of which election shall be set in accordance with the provisions of the Texas Election Code, but not more than 78 days from the date such petition was certified to the City Commission by the City Secretary, or from the date of the public hearing if one was held, whichever date is later.
