For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
ACCOUNT CUSTOMER. A person in whose name a city garbage service collection account is billed.
ALLEY. A public way generally 20 feet in width used for public utility purposes and as an alternate, secondary or emergency route for vehicle and pedestrian traffic generally situated at the rear of a property lot.
AUTHORIZED REFUSE COLLECTION CONTRACTOR. The person authorized by the city to provide garbage collection service to a premises in the city.
BIN. A metal receptacle, commonly referred to as a dumpster, created for the purpose of storing garbage for collection and designed to be lifted and emptied mechanically.
BIN SERVICE. Garbage collection service provided by the city's authorized refuse collection contractor through use of a bin.
BULKY WASTE. Household items such as stoves, refrigerators, water heaters, washing machines, bedding, furniture, but does not include rubbish, construction debris or hazardous waste.
CART. A 96-gallon wheeled cart provided by the city, through its authorized refuse collection contractor, for the purpose of storing and collecting garbage.
CITY. The City of Port Isabel, Texas.
COLLECTION AREA. The area within 20 feet of a bin or cart placed at curbside for regular garbage collection.
CONSTRUCTION DEBRIS. Waste building materials resulting from roofing, construction, remodeling, repair or demolition, but not waste materials generated by a commercial contractor, and not including bulky waste, rubbish or hazardous waste.
CURBSIDE. Behind or alongside the curb of a street, but not in the street or sidewalk nor in any place which interferes with vehicular or pedestrian traffic.
DEPOSIT. To cast, throw, drop, place, unload, dump or in any other manner relinquish control.
GARBAGE. Waste and trash generated by human habitation and small commercial accounts, but does not include rubbish, bulky waste, construction debris or hazardous waste.
GARBAGE COLLECTION. The twice weekly curbside collection of garbage in 96-gallon wheeled carts and the periodic collection of rubbish, bulky waste and construction debris from residential and small commercial premises.
GARBAGE COLLECTION SERVICE. Regularly scheduled garbage collection provided by the city through the city's authorized refuse collection contractor.
HAZARDOUS WASTE. Waste which is defined or characterized by a governmental agency as hazardous or requiring special disposition such as tires, petroleum containers, automobile batteries and similar items.
MUNICIPAL UTILITY SERVICE. Utility service provided by the city to an owner or occupant of a premises in the city including garbage collection service.
OCCUPANT. The resident, tenant, lessee, manager, supervisor or person in charge of the premises and the person in whose name the utilities are billed. If the occupant of the premises and the person to whom utilities are billed are not the same person, then each shall be and are hereby deemed to be the OCCUPANT for purposes of this subchapter.
OWNER. The fee title holder of the premises and the person in whose name ad valorem taxes are billed. If the person to whom the ad valorem taxes are billed is not the same person as the fee title holder, then each shall be and are hereby deemed to be the OWNER for purposes of this subchapter.
PERSON. Whether an owner or occupant as defined herein, means and includes any individual, partnership, corporation, company, venture, association, trust, estate, foundation, institution, organization, group, governmental agency and any other entity recognized by law as the subject of rights and duties whether operated for profit or not for profit.
PREMISES. A lot, tract or parcel of land located within the city limits used for residential, commercial or any other purpose with either:
(1) A building or structure located thereon;
(2) A mobile home, HUD-Code manufactured home or recreational vehicle located thereon; or
(3) A vessel docked, anchored or located adjacent thereto.
RESIDENTIAL PREMISES. A premises used for human habitation not utilizing a bin or provided with bin service.
RUBBISH. Clean waste wood, wood products, yard waste, tree limbs and trimmings, grass cuttings, shrubs, plants, weeds, leaves, printed material, paper, pasteboard, rags, discarded clothing and similar household waste, but not including bulky waste, construction debris or hazardous waste.
SMALL COMMERCIAL PREMISES. A premises used for a commercial or nonresidential purpose not utilizing a bin or provided with bin collection service.
UTILITY SERVICE. Active water and/or sewer service.
VESSEL. Every kind of watercraft including ships and boats.
