(a) No person shall place or dispose of rubbish, garbage, refuse, bottles, cans or debris of any kind in the public property of the City except in such places and within such receptacles as are provided by the City in public areas. Residents on private property shall not dispose of rubbish, garbage, refuse, bottles, cans or debris accruing from such residence in any refuse receptacle provided for users of City-owned or controlled land. The owner of such rubbish, garbage, refuse, bottles, cans or debris of any kind shall not be relieved of any responsibilities under the provisions of this section if the rubbish, garbage, refuse, bottles, cans or debris is under the control or possession of any other person.
(b) Any rubbish, garbage, refuse, bottles, cans or debris found on public property of the City which is identified as being that of a resident is prima-facie evidence of a violation of this section. (Ord. 21-77. Passed 5-24-77.)
(c) Whoever violates this section is guilty of a minor misdemeanor for a first offense. If the offender previously has been convicted of or plead guilty to one violation of this section, then whoever violates this section is guilty of a misdemeanor of the fourth degree.
