Whoever violates any provision of this chapter is guilty of a misdemeanor of the third degree. If, within one year of the offense, the person charged with a violation of any provision of this chapter previously has been convicted of, or plead guilty to, a violation of any provision of this chapter, then whoever violates of any provision of this chapter is guilty of a misdemeanor of the second degree.
