(A) (1) It shall be unlawful for any person to sell fireworks of any description whatsoever except permissible fireworks.
(2) (a) PERMISSIBLE FIREWORKS shall mean only sparklers; Vesuvius fountains; spray fountains; torches; color fire cones; star- and comet-type color aerial shells without explosive charge for the purpose of making a noise; lady fingers, not to exceed seven-eighths of an inch in length or one-eighth of an inch in diameter, total explosive composition not to exceed 50 milligrams each in weight; color wheels; and any other fireworks approved by the state’s Fire Marshal.
(b) PERMISSIBLE FIREWORKS shall mean only those fireworks annually listed and promulgated by the state’s Fire Marshal in Title 157 NAC Chapter 8, “Fireworks Acceptable in the State of Nebraska.”
(3) Permissible fireworks may be sold at retail only between June 24 and July 5 of each year.
(B) Notwithstanding the provisions of this subchapter, the City Council may permit fireworks of any description for the purpose of public exhibitions or display.
(C) The sale of permissible fireworks shall be unlawful, except from a duly licensed retailer at a stand or building solely for the purpose of selling permissible fireworks, which stand or structure shall be located at a distance of at least ten feet from any other existing structure. It shall be unlawful for any person or persons, firm, partnership or corporation to possess for sale at retail or store or keep any fireworks of any description within the city, provided that the possession and storage shall be permissible between June 24 and July 5 of each year.
