3-2-9: HEARING PROCEDURE; SCOPE OF DISCIPLINARY ACTION:
   A.   Employee Request For Hearing: If an employee files a request with the personnel board for a hearing as provided for in the city's personnel policy and procedure manual, the personnel board shall schedule a hearing at the earliest possible time, but in no case later than three (3) weeks from the date of receipt of the request. At the discretion of the employee the hearing may be private or open to the public.
   B.   Informal Procedure: In conducting the hearing, the procedure shall be informal and it shall be assumed that the action complained of was taken in good faith unless proved otherwise.
   C.   Action Favoring Employee: If the personnel board finds the action appealed from was improper, the employee shall be reinstated to his/her former position without loss of pay or the personnel board may impose a lesser form of disciplinary action, but in no case shall disciplinary action be increased.
