10-3-5: REVOCATION OF CERTIFICATE OF REGISTRATION:
   A.   Reasons For Revocation: Any certificate of registration issued under the provisions of this chapter may be revoked, suspended or the holder thereof put on probation or sanctioned, following a hearing before the construction appeals board for the following reasons, if the board finds by clear and convincing evidence that the holder has: (1980 Code § 19.5-6; amd. 2003 Code)
      1.   Made a material misstatement in the application for any license or renewal thereof;
      2.   Loaned or is illegally using a license;
      3.   Violated any provisions of this code;
      4.   Demonstrated incompetence to act as a journeyman or apprentice HVAC tradesperson or HVAC contractor;
      5.   Violated any provisions of the Oklahoma mechanical licensing act 1 , or any rule, regulation or order prescribed by the state committee of mechanical examiners or any ordinance or regulation for the installation of mechanical facilities made or enacted by a city or town by authority of the mechanical licensing act; or
      6.   Wilfully failed to perform normal business obligations without justifiable cause. (1980 Code § 19.5-6)
   B.   Notice Of Hearing: All such hearings shall be preceded by actual notice of the hearing to the certificate holder, reasonable time for preparation after receipt of notice, right to confront witnesses, right to subpoena witnesses and such other due process rights as are provided by law. (1980 Code § 19.5-6; amd. 2003 Code)
   C.   Revocation Of State License: The board may further recommend in writing to the state construction industries board that the state license of the person charged with misconduct also be revoked. (Ord. 6125, 7-12-2010)
