9-2-7: UTILITY CUTS; PAYMENT OF COSTS:
   A.   Permit Required: Whenever it shall be necessary to cut or remove any pavement, walk, drive, curb and gutter or excavate in any roadway, the person making such cut or excavation shall secure a permit therefor from the City Engineer or his designee. A separate permit shall be issued for each cut made, provided that more than one (1) cut may be covered by a single permit, if located on a single connected installation of new pipe or conduit.
   B.   Replacement Fees: Replacement fees on utility cuts shall be separately calculated for each permit, on the basis of actual cost.
   C.   Backfilling: All excavations shall be carefully backfilled by the persons making the same, and the surface, whether or not paved, must be restored with like kind of materials, and grade, as existing surface. Other methods of backfilling shall be approved by the City Engineer. Only selected materials shall be used in making the backfill. No broken concrete, rubble or debris shall be used as backfill.
   D.   Compliance With City Regulations: In case refilling of any excavation is not done in accordance with this chapter and the rules and regulations of the City, and in a manner satisfactory to the City Engineer, then the City Engineer shall have the right to cause to be taken out all the materials from the excavation and have the same refilled in a proper manner at the expense of the party or parties originally making the excavation.    E.   Manner Of Payment: No assessment nor installment thereof to be made pursuant to this section shall be paid other than in cash. (1980 Code § 30-44)
