7-3-13: LESTER AND MARY CANN MEMORIAL GARDENS; BIRD SANCTUARY:
   A.   Area: The entire area embraced within the limits of the Lester And Mary Cann Memorial Gardens, located in the south one-half of the northwest quarter of Section 26, Township 26 North, Range 2 East, Kay County, Oklahoma, is hereby designated as a bird sanctuary.
   B.   Trapping Or Shooting Prohibited: It shall be unlawful to trap, hunt, shoot or attempt to shoot, or rob the nests, or molest in any manner any bird or wild fowl on these premises. Provided, however, if starlings or similar birds are found to be congregating in such numbers in a particular locality within the sanctuary that they constitute a nuisance or menace to health or property, in the opinion of the proper health authorities of the city, then in such event, said health authorities shall meet with representatives of the Audubon Society, Bird Club, Garden Club or Humane Society, or as many of said clubs as are found to exist in the city after having given at least three (3) days' actual notice of the time and place of said meeting to the representatives of said clubs. If, as a result of such meeting, no satisfactory alternative is found to abate such nuisance, then said birds may be destroyed in such numbers and in such manner as is deemed advisable by said health authorities, under the supervision of the chief of police.
   C.   Identification Plaques: Plaques identifying these premises as a bird sanctuary shall be allowed, provided that the materials and installation of said plaques be approved and supervised by the city traffic engineering department. (1980 Code § 7-15)
   D.   Penalty: Anyone violating the provisions of this section shall be subject to penalty as provided in section 1-4-1 of this code. (1980 Code § 7-15; amd. 2003 Code)
