A. Illegal Possession; Penalty; Confiscation: In addition to the penalty otherwise provided for the illegal possession of a weapon, the judge of the municipal court may order and adjudge any weapon or article found concealed on any person in violation of 21 Oklahoma Statutes section 1272 as an instrument used in violation of the public safety and in the furtherance of a nuisance, and may order same to be destroyed by the chief of police in case said articles have no particular value; but if same may have any particular value for a lawful purpose, it may be ordered by said judge to be held for a period of six (6) months by the chief of police, and after giving all persons claiming an interest therein, if such persons are known to the chief of police, notice in writing for a period of not less than five (5), nor more than fifteen (15) days, such article may be sold after six (6) months from the date of the first of such notices; and the proceeds therefor shall be turned over to the finance director the same as a fine or forfeiture, and the chief of police shall make due report to the city clerk of all articles sold, and the proceeds from such sale. B. Discharging Firearms, Air Guns: It is unlawful for any person to discharge a firearm in the city except when doing so in the line of duty, when doing so in defense of oneself, of another person or of property or on firing ranges existing as of the date of the ordinance codified herein or when otherwise authorized by this code or any law or ordinance. It is unlawful to discharge an air rifle, BB gun, pellet gun or slingshot in the city. Any person violating the provisions of this subsection shall be deemed guilty of an offense subject to fine and/or within the jurisdictional limits of the municipal court. (Ord. 6076, 3-24-2008)
