5-8-11: GEOGRAPHICAL COVERAGE:
   A.   Cable System: Grantee shall design, construct, operate and maintain the cable system throughout the entire permit area pursuant to the provisions of this chapter and any permit agreement.
   B.   Line Extensions: In all areas of the permit area, the grantee shall be required to extend its cable system pursuant to the following requirements:
      1.   Grantee must extend and make the cable system available to every residential unit in all unserved, developing areas having at least twenty five (25) residential units per cable mile as measured from the existing cable system, and shall extend its cable system simultaneously with the installation of utility lines provided that the grantee is provided timely notice of such extensions.
      2.   Grantee must extend and make the cable system available to any isolated resident requesting connection at the standard connection charge, if the connection to the isolated resident would require no more than a one hundred fifty foot (150') aerial drop line.
   C.   Early Extension: In areas not meeting the requirement for mandatory extension of service, grantee shall provide, upon the request of a potential subscriber desiring service, an estimate of the costs required to extend service to said subscriber, and if agreeable by the resident, such connection shall be made on a 50/50 cost sharing basis. Grantee may require advance payment or assurance of payment satisfactory to the grantee. The amount paid by subscribers for early extension shall be nonrefundable, however, in the event the area reaches within ten (10) years the density required for mandatory extensions, such resident's payments shall be credited against the subscriber's subsequent bills.
   D.   New Development Underground: In cases of new construction or property development where utilities are to be placed underground, the developer or property owner shall give the grantee reasonable notice of such construction or development, and of the particular date on which open trenching will be available for grantee's installation of conduit, pedestals and/or vaults, and laterals to be provided at grantee's expense. Grantee shall also provide specifications as needed for trenching. Costs of trenching and easements required to bring service to the development shall be borne by the grantee.
   E.   Areas Not Covered By Agreement: Nothing herein shall be construed to prevent grantee from serving areas not covered under this section upon agreement with developers, property owners, or residents. (Ord. 6007, 8-23-2004)
