If the owner of an animal has entered into an agreement with the Animal Control Division by way of a notarized affidavit as to specific conditions set forth by the Animal Control Division and agreed to by the owner, then such agreement is held to be binding and any violation thereof shall result in a fine in the amount of $500.00 first offense, second offense $500.00, third offense mandatory court appearance.
