(A) If the death, withdrawal or removal from the ballot of a qualified candidate occurs following the end of the qualifying period leaving fewer than two candidates for an office and there remains 23 days or more before the election, the qualifying period shall be re-opened for two days following the date the vacancy occurs. The remaining candidate shall not be required to requalify. Any and all additional candidates qualifying for such office shall be placed on the ballot.
(B) If the death, withdrawal or removal from the ballot of a qualified candidate leave only one qualified candidate and there are 22 days or less remaining prior to the scheduled election or, if following the additional qualifying period there remains only one qualified candidate, then the provisions of § 35.05 of this chapter shall apply.
