§ 34.200 MONEY PURCHASE PLAN AND TRUST.
   (A)   The city shall establish a money purchase plan and trust as provided for under Section 401(A) of the Internal Revenue Code for the benefit of persons in the following positions who are not employees as defined in § 34.010:
      (1)   Director of Planning and Growth Management
      (2)   Assistant City Manager
      (3)   Assistant to City Manager
      (4)   Budget Officer
      (5)   Public Works Director
      (6)   Utilities Director
      (7)   Parks and Recreation Director
      (8)   City Engineer
      (9)   Finance Director
      (10)   Personnel Director
      (11)   Public Works Administrator
      (12)   Special Projects Manager
      (13)   Capital Projects Manager
      (14)   City Attorney
      (15)   Assistant City Attorneys
      (16)   City Clerk.
   Persons serving as the City Attorney, Assistant City Attorneys and City Clerk as of the date of this ordinance may at their option continue to also participate in the 457 Deferred Compensation Plan, however, any retirement contribution made by the city on their behalf subsequent to the effective date of this section shall be made to the 401(A) Money Purchase Plan and Trust.
   The money purchase plan and trust agreement shall be approved by separate ordinance.
   (B)   The Personnel Director, or his/her designee, is hereby authorized to execute the required employer acknowledgment with each employee who participates in the plan.
