§ 32.74 ANIMALS.
   (A)   The Chief of Police, with the approval of the City Manager, may dispose of animals owned by the city and utilized by the Police Department, provided such action is in the public interest and will not subject an animal to inhumane treatment. The authority to dispose of an animal shall include the authority to donate an animal to another governmental entity or a not-for-profit organization, provided the organization has adequate facilities to care for the animal, and shall include the authority to destroy an animal in the appropriate circumstances.
   (B)   The Chief of Police, with the approval of the City Manager, shall also have the authority to accept a donated animal to be utilized by the Police Department, provided the accepted animal can be adequately maintained with existing budgeted funds.
