§ 71.109 ENGINE AND COMPRESSION BRAKING PROHIBITED.
   (A)   It shall be unlawful for the operator of any vehicle to use or permit the use within the city of any engine brake, compression brake or mechanical exhaust designed to aid in the braking of the vehicle which creates any noise which is audible by a person of normal hearing capability at a distance of 300 feet.
   (B)   This section shall not apply to the use of such techniques or devices when necessary to avoid a collision between the vehicle and any other vehicle, person or property.
   (C)   The penalty for a violation of this section shall be as provided in § 10.99.
