§ 91.01 LICENSE REQUIRED.
   Notwithstanding any prior ordinance concerning this issue, a liquor licensee may sponsor live band performances on the licensed premises after having secured a permit therefor as provided below. Nothing herein shall be construed as permitting a nuisance due to excessive noise.
   (A)   Liquor licensees may apply to the City of Polo Local Liquor Commissioner for a permit to allow for live band performances on the premises. However, if the live band performance(s) end by 6:00 p.m., no permit shall be required.
   (B)   The liquor licensee must apply to the Local Liquor Commissioner for such permit at least five days prior to the date of the live band performance. No fee shall be charged for the permit. The corporate authorities reserve the right to amend the requirements for obtaining a permit from time to time.
   (C)   The times during which live band performances will be authorized are as follows:
      (1)   Sundays: Noon until 8:00 p.m. except when a Sunday falls the day before a banking holiday, then the permitted hours shall be extended until midnight.
      (2)   Mondays - Saturdays: Noon until midnight except on the Wednesday preceding Thanksgiving, the hours shall be extended until midnight.
      (3)   December 31 each year: Noon until midnight.
