(a) Density.
(1) Not more than sixty percent of the land comprising the R1-PUD shall be used for foundations of dwellings and garages.
(2) Notwithstanding paragraph (a)(1) hereof, and with the exception of R1-PUD's which incorporate and eliminate prior nonconforming uses, the number of single- family dwellings shall not exceed one per each 15,000 square feet of land within the development. In the case of R1-PUD's which incorporate nonconforming uses existing prior to the 1978 Comprehensive Zoning Plan, and where the incorporation of such nonconforming uses will reduce the density of families per unit or units per land area, the Planning Commission, as part of the plan review described in Section 1276.03, may recommend and Council may approve a greater density of single-family dwellings, but not in any case to exceed fourteen dwellings per acre. No variances beyond these density levels shall be permitted under any circumstance.
(b) Required Common Open Space. Within the tract to be developed on a planned unit basis, a minimum land area of forty percent of the entire tract shall be required for use as common open space. This common open space may include the front, rear and side setback areas, pedestrian walkways, parkland, open areas, drainageways, drives, streets, nonenclosed parking areas and landscaped islands in any parking area. At least twenty percent of the land area of the entire tract shall be comprised of lawn and/or landscaped areas. Isolated or fragmented pieces of land which do not serve a purely residential function, such as landscaped islands in parking areas, shall not be included in calculating said lawn and/or landscaped area.
(c) Setback Lines.
(1) Front setback lines shall not be less than ten feet. No building or any appurtenance thereto shall extend beyond the front setback line. All parking is prohibited in front of the front setback line.
(2) Side setback lines shall not be less than ten feet.
(3) Rear setback lines shall not be less than twenty feet.
(d) Height. Building height shall not exceed thirty-five feet from grade to the highest point on any structure. As used herein, the “highest point” on a structure shall be the highest point on the roof, if a flat roof, the deckline of a mansard roof, and the mean height between eaves and ridge for gable, hip and gambrel roofs. The front foyer or main entrance door shall determine the grade where any dispute may exist.
(e) Variances. As part of the plan review described in Section 1276.03, the Planning Commission may recommend and Council may approve variances to the required common open space, setback lines and height requirements.
