(a) Intent. To establish and preserve areas for offices and services to the public which do not materially detract from nearby residential uses.
(b) Principal Permitted Uses.
(1) Any use permitted in a Residential District.
(2) Two-family dwellings.
(3) Townhouses or Townhouse apartments.
(4) Professional offices, which shall have the primary function of providing services which require the provider to hold a valid license issued by the State to practice, such as:
Real estate
Insurance
Attorney at law
Medical practitioner
Dentistry
Optometry
Architecture.
(5) Service businesses, which shall have the primary function of providing customers with a service, such as:
Banking or investments
Advertising
Public utilities
Daycare for pre-school age children
Hair salons
Photography
Interior designer
Appraiser of real estate or other tangible assets
Tailor
Computer consulting.
(6) Library, post office or other public building.
(7) Assisted living facility.
(8) Restaurants serving food only at tables with limited carry out, permitted only when the primary service is for on-site consumption. Delivery service, food service to vehicles or drive-thru service is prohibited.
(9) Mixed uses.
(10) General offices.
(c) Restrictions.
(1) For all proposed developments, preliminary plans shall be submitted to the Planning Commission for its consideration and approval. Final site plans must be submitted prior to the commencement of any work to the proposed site, and will become the property of the Village. All plans submitted shall use a scale of one inch equals twenty feet and shall adequately show:
A. The site plan, including 100 feet beyond, and side elevations of proposed grades of the entire site, as well as existing grades.
B. An overview and side elevation of the size, location and adequacy of existing and proposed public and private utilities, which shall include water, sanitary and storm sewers, electric, cable, telephone or any other utility.
C. An overview and side elevation of the size, location and adequacy of existing and proposed drainage. Proposed plans will have retention areas of at least ten percent larger than 100-year storm retaining.
D. The design of access to and egress from parking and services.
E. An overview and side elevation of the entire proposed site design, with the height, width and overall size dimension of each site plan addition, and showing all existing structures on the site plan.
(2) In any area accessible to utilize underground utilities, all new development shall propose the use of underground utilities on any site plan.
(3) No proposed structure shall exceed an exterior dimension of 8,000 square feet on a footprint.
(4) Proposed structures shall be placed in an area of the proposed site that will keep the existing and surrounding street front line. The front setback must meet the direct line of adjacent properties. Where a proposed site exists without adjacent structures, it shall be placed in line with the nearest existing structure.
(5) Parking shall not be located in the front. Parking shall not be visible to the street front. Screening shall be approved by the Architectural Review Board.
(6) Retail sales may only be offered when the business does not depend on retail sales of stocked merchandise as a primary function of the business.
(7) Any other information which is needed to ensure that the proposed land use and structures will place no undue burden upon the street systems of the Village, adjoining property owners and the Village, shall be supplied. The proposed new land use shall comply with the land use plans of the Village.
(8) Drive-thru services of any nature are not permitted.
(9) Hours of operation for any business in the district are limited to 6:00 a.m. to 9:00 p.m.
(10) Any occupant in the District must complete an occupancy permit with the Zoning Administrator prior to occupancy of the premises.
(11) Sidewalks shall be provided and shall be five feet wide and placed eight feet from the curb.
(12) Trees shall be placed in the eight-foot devil's strip (known as the parkway), at a distance of twenty-five feet on center. Trees shall be a minimum of twelve feet in height and have a three and one-half inch caliper. Tree species shall be approved by the Village Tree Commissioner and local utility companies.
(13) An approved lamp post shall be placed on the inside of the sidewalks and shall be sixty feet on center. The approved lamp posts shall be manufactured by Hinckley, in the “Village Series”, or an equivalent approved by the Architectural Review Board. The order numbers are as follows:

(d) Definitions. As used in this section, the following words and terms shall have the meanings set forth herein:
(1) Advertising -A business which has the primary function of providing the service of one or more of the following: producing advertisements, selling advertisements to the public, etc.
(2) Appraiser -An establishment that offers the service of appraising tangible items to establish the value.
(3) Architecture -A person who is certified by the State or holds a Master's degree to practice architecture.
(4) Assisted Living -See Section 1260.05(3).
(5) Attorney at law -A person who has passed a state bar examination to practice law.
(6) Banking/investments -A financial institution which secures tangible money in the form of currency, stocks, bonds, etc., or invests such items for the purpose of increasing the value of such.
(7) Carry-out -A business which offers prepared food for human consumption off of the premises.
(8) Computer consulting -An establishment that supplies information, software and hardware to the public solely for electronic computers.
(9) Daycare -A facility that offers care for pre- school age children, that is certified by the State.
(10) Dentistry -A person who is certified by the State to practice dentistry.
(11) General office -Any business that utilizes space for the sole purpose of office space, and the primary function of the business conforms to the intent of the establishment of the District. All general office functions must be approved by the Planning Commission.
(12) Hair salon -An establishment that provides a personal hygiene service to the public, where personnel hold a certificate from the State to practice cosmetology.
(13) Insurance -A business which has the primary function of providing the public with a service of obtaining insurance. The types of insurance may be life, health, property, etc.
(14) Interior design -A person who holds a degree to practice interior design.
(15) Library -A public library.
(16) Medical practitioner -A person who is certified by the State to practice medicine.
(17) Mixed use -Occupants of a one, two or three- story building, where both residential apartments and one or more other occupancies of the professional office and service uses are utilized.
(18) Optometry -A person who is certified by the State to practice optometry.
(19) Overview -A view which indicates the location of specific items arranged as though the viewer were looking down onto the site. All items should be in footprint.
(20) Photography -An establishment that offers the service of taking photographic pictures of subjects and producing a final photograph.
(21) Public building -Any building operated by one or more Village, State or Federal Government funded operations.
(22) Public utilities -Any utility company that offers service to the public.
(23) Real estate -A business which has the primary function of providing the public with a service to purchase or sell real property.
(24) Restaurant -A business which offers prepared food for human consumption on the premises.
(25) Side elevation -A view which shows the side of specific items arranged as though the viewer were looking at a side (north, south, east or west, right or left) of the site. Elevations should be shown on this view.
(26) Tailor -An establishment that alters clothing apparel.
(27) Town house/apartment -Residential housing that supplies multi- family dwellings in a single structure with a minimum of two stories in height and a maximum of three stories in height.
(28) Townhouse - An attached, privately owned single-family dwelling unit which is part of and adjacent to other similarly owned single-family dwelling units that are connected to but separated from one another by a common party wall having no doors, windows, or other provisions for human passage or visibility.
(28) Two-family dwelling - Residential dwellings that are occupied by two families as a duplex, an apartment, or a condominium.
