270.09   VACATIONS.
   (a)   Paid Vacation Eligibility.  Full-time employees shall be entitled to paid vacation leave, at their current rate of pay, according to accrued continuous service, less unpaid sick leaves, disciplinary time off, leaves, other interruptions in service or disciplinary probation periods as follows:

Full-time employees may take vacation leave to which they are entitled beginning with the first full pay period following the date they complete the required years of service.
   (b)   Computations for Eligibility.  Years of continuous service shall be computed based on active payroll records.  Credit for actual active military service will be allowed.
   (c)   Scheduling.  A complete annual vacation request schedule, with vacation taken in full week units, must be submitted in writing before April 1, and must be approved by the appropriate department supervisor.  No less than one week (seven calendar days) in advance, an employee may request that the employee's supervisor modify the employee's written schedule.  The decision as to whether to grant a change in the vacation schedule, including the use of vacation days in less than full week units of five consecutive days, is solely at the discretion of the supervisor based upon staffing needs.
   (d)   Accumulated Vacation Time.  Vacation leave shall be taken prior to an employee's next anniversary date or the employee shall forfeit the vacation time and/or pay.  The Mayor, with the consent of Council, may permit a ninety-day extension period should an employee be forced to adjust his or her vacation due to a Village emergency.  At no time shall two employees of the same department be granted the same week or weeks of vacation or time off for military leave.  Wherever possible, employees will be accommodated on their request for vacation scheduling.  When duplicate weeks are requested, department seniority shall prevail in the approval of a vacation schedule.
   (e)   Unused Vacation Time.  Unused, accumulated vacation leave, pro-rated to the time of separation, shall be paid at the time of such separation to any employee who leaves the employment of the Village for any reason or is permanently laid off.  Unused, accumulated vacation time of active full-time employees shall be paid to the surviving spouse or estate of any employee who dies, pro-rated to the date of his or her death.
   (f)   Vacation Pay in Lieu of Vacation Time for Administrative Assistant.  The Administrative Assistant may, with the approval of the Finance, Wage and Insurance Committee, work his or her vacation at his or her regular rate of pay in lieu of taking his or her vacation time.
