(a) There is hereby established the position of Acting Police Chief.
(b) The position established herein shall be a temporary position which terminates upon the occurrence of either of the following:
(1) The return of the Police Chief to active duty.
(2) Should the employment of the Police Chief be terminated, for any reason, the appointment of a new Police Chief.
(c) The salary of the Acting Police Chief shall be determined from time to time by Council and shall be payable in twenty-six equal installments. Said salary shall be the sole and exclusive compensation paid to the Acting Police Chief. However, the Acting Police Chief may earn overtime pay at an hourly rate for hours worked in the Poland Selective Enforcement Program. The hourly rate shall be determined from time to time by Council. The Acting Police Chief may earn overtime compensation only for those hours previously approved in writing by the Mayor.
(d) It is the intent of this section that the position of Acting Chief of Police be a temporary appointment. If a court of competent jurisdiction rules that the Village has no authority for making such an appointment, or if a permanent Police Chief is appointed, or if a current Chief returns to active service, then the salary of the Acting Police Chief shall be reduced to the rate of pay for a full-time patrolman then in effect.
