258.09   AUXILIARY POLICE.
   (a)   Establishment.  There is hereby established, under the authority of Ohio R.C. 737.161, an Auxiliary Police Department in and for the Village.
   (b)   Appointment.  There shall be appointed by the Mayor, on recommendation of the Police Chief, auxiliary policemen in a number not to exceed ten.  All appointees shall be by consent of a majority of Council.
   (c)   Dismissals.  All dismissals shall be by recommendation of the Police Chief and the Mayor.  Auxiliary policemen shall have such right of appeal from dismissal as is set forth in Ohio R.C. 737.19.
   (d)   Compensation and Uniforms.  Auxiliary policemen shall be compensated at a rate of one dollar ($1.00) per year.  A policeman shall pay for his or her own uniform and equipment, which shall consist of the following:
      (1)   Black trousers.
      (2)   Gray uniform shirt with auxiliary patches.
      (3)   Black, eight-point hat.
      (4)   Black, plain-toed shoes.
      (5)   Night stick and chemical mace. (No firearms are to be authorized at any time.)
   (e)   Appointee Qualifications.  The applicant shall be at least twenty-one years of age, a high school graduate or equivalent, a U.S. citizen and in good physical condition.
   (f)   Rules of Conduct.  Without limiting the inherent power of the Mayor, members of the auxiliary police shall be subject to disciplinary action or dismissal for violation of the following rules of conduct:
      (1)   For intoxication while on duty or while in uniform.
      (2)   For using intoxicating liquor at any time to excess, either on or off-duty.
      (3)   For willful disobedience of any order lawfully issued to him or her by the Mayor, Acting Mayor or officer in charge.
      (4)   For incompetency to perform the duties of his or her office.
      (5)   For conviction of any crime other than traffic offenses.
      (6)   For conduct amounting to gross neglect of duty.
      (7)   For conduct subversive to the good order and discipline of the Police Department.
   (g)   Duty Rules and Regulations.  The duty rules and regulations of the auxiliary police shall be as follows:
      (1)   Auxiliary police shall be on duty only when scheduled by the Chief of Police or the Mayor.
      (2)   Auxiliary police shall assist the officer on duty only when so directed.
      (3)   Officers shall act at all times under the direction of the Chief of Police or officer in charge, but shall at no time have the power to arrest.
      (4)   Officers shall be in full uniform while on duty.
      (5)   Officers shall assist in traffic control.
      (6)   Officers do not have authority to operate police vehicles or equipment, unless instructed by the Chief of Police, Mayor or officer in charge.
