1289.99   CRIMINAL PENALTIES.
   (a)   Any owner or person in control who violates or fails to comply with any provision of this chapter, or any order issued by the inspector or his or her designee, after notice pursuant to Section 1289.06, shall be guilty of a minor misdemeanor for a first offense and fined up to one hundred fifty dollars ($150.00). For a second or subsequent offense, the person shall be guilty of a misdemeanor of the third degree and shall be fined not more than five hundred dollars ($500.00), or imprisoned not more than sixty days, or both.
   (b)   Organizational liability shall be available in any prosecutions under this Code.
   (c)   Completion of any administrative appeals process is not a prerequisite to criminal prosecution.
   (d)   The minor misdemeanor penalties of this Code are specifically intended to impose strict liability. For a second or subsequent offense, the requisite intent may be inferred from past violations.
