§ 97.17  RESTORATION COSTS.
   (A)   Before a permit may be issued to make an excavation in the surface of an improved public street or alley, the applicant shall deposit with the Clerk-Treasurer, in addition to the fee provided for by § 97.16, $6 for each square foot of surface material removed or disturbed, to cover the cost of restoration by the village. As soon as practical after the completion of the work to be performed by the applicant, the village shall repair the surface of highway removed by the applicant with bituminous surface material or with a paving material of equivalent quality. If, after a period of 60 days from the date of the repair by the village of the surface of any highway, it is determined by the Village Administrator or other officer designated by Council that the opening has been adequately filled by the applicant, the village shall refund to the applicant that portion of the amount advanced by him or her in excess of the cost of restoration.

   (B)   In addition to the fees required in § 97.16 and division (A) above of this section, there shall be a charge of $300 for an excavation in any street within three years from the date such street was paved or resurfaced.
