§ 53.02  EXPANSION OF UTILITIES AND SEWERS BEYOND CORPORATE LIMITS.
   (A)   No utilities or sewer owned, operated or controlled by the village shall be extended beyond the corporate limits of the village, nor shall any such utility be sold, bartered, donated or supplied in any manner to service property, persons, corporations or things not situated or permanently located within such corporate limits unless approved, upon application, by a majority of Council.
   (B)   This section shall have no application in instances where utilities of any nature have previously been extended beyond the corporate limits, but shall, on and after the date of the enactment of this section (Ordinance 8-71, passed June 15, 1971), prohibit expansion, enlargement or extension of such facilities presently in existence and maintained and controlled by the village outside its corporate limits unless approved, upon application, by a majority of Council.
   (C)   Notwithstanding the provisions of divisions (A) and (B) hereof, utilities may be supplied for use and consumption outside the corporate limits for purposes of fighting and preventing fires and for any emergency, temporary in nature, declared by the Mayor to exist.
