3-5-6: RECEPTACLE REQUIREMENTS:
   A.   No owner or occupant of any public or private premises shall permit to accumulate upon his premises any garbage, refuse or trash, except in automated collection receptacles furnished by and through the city contractor. Any articles that cannot be fit into the automated receptacles will be removed from the premises by the city or contractor so long as they are fastened, tied or secured in bundles, not to exceed five feet (5') and not to exceed sixty (60) pounds in weight, excepting articles on special hauls arranged between the owner or occupant and the city or its contractor. Any articles which cannot fit into the automated collection receptacles, or are removed on special hauls, shall be assessed an overage charge, as shall be adopted by the mayor and city council, to be paid with the utility bill of the owners or occupants of the premises in accordance with section 3-5-3 of this chapter.
   B.   Automated collection receptacles shall be furnished by and through the city contractor to the owner or occupant of the premises, which shall be the sole source of garbage and refuse disposal, except for bundled articles, and those removed on special hauls, as referred to in subsection A of this section. Automated collection receptacles, when filled, shall not exceed the rated capacity for volume or weight, as specified by rule or regulation of the city council, in accordance with section 3-5-4 of this chapter. Any automated collection receptacle which exceeds the specified rate of capacity for volume or weight at the time of pick up shall be assessed an overage charge, as shall be adopted by the mayor and city council, to be paid with the utility bill of the owner or occupant of the premises in accordance with section 3-5-3 of this chapter.
   C.   All owners or occupants shall see to it that the contents of the automated collection receptacles are not frozen or stuck and will dump out readily when such receptacle is inverted for disposal.
   D.   Automated collection receptacles shall be properly placed for pick up in accordance with rule or regulation of the city council, in accordance with section 3-5-4 of this chapter. During periods of snow, automated collection receptacles must be placed on the road side of snow berms.
   E.   No automated collection receptacle shall be placed within six feet (6') of any stationary object or vehicle. Alleys and streets within the city may be designated for pick up on one side of the street or alley, as specified by rule or regulation of the city council, in accordance with section 3-5-4 of this chapter.
   F.   Automated collection receptacles shall be assessed for damage or theft on a regular basis. All theft and any damages, beyond reasonable wear and tear, shall be assessed a surcharge, as shall be adopted by the mayor and city council, to be paid with the utility bill of the owner and occupant of the premises, in accordance with section 3-5-3 of this chapter.
