3-1-9: PROHIBITED ANIMALS, ACTS AND CONDITIONS:
   A.   Nuisance Animals: It shall be unlawful and deemed a public nuisance for any person to harbor within the city any animals or classes of animals which create a noisome, offensive or insanitary condition including, but not limited to, pigs, goats and sheep; the determination of whether such condition exists shall be vested in the city council. When it is determined by said council that any person comes within the purview of this section, thirty (30) days' notice, in writing, shall be given to such person, and upon failure to abate the nuisance created by such animals, the remaining provisions of this section shall become immediately effective with respect to abatement of said nuisance and penalty for violation of this section.    B.   Dog Kennels: It shall be prohibited to have a dog kennel in residential and commercial zoned areas within the city. A kennel shall be deemed any premises or portion thereof, on which three (3) or more dogs, six (6) months or older are maintained, harbored, possessed, boarded, bred or cared for.
   C.   1. Livestock: It shall be lawful to possess livestock not classed as nuisance animals within the city limits, upon the following terms, conditions and restrictions: All animals and poultry shall be kept under sanitary conditions in accordance with the health department and humane society rules and regulations. Particular emphasis shall be placed on maintaining adequate control over odors and noises emitted and on adequate pest control. All poultry and animals shall be kept in adequately fenced enclosures or buildings. Large livestock shall be limited to one large animal per clear acre and shall be kept in adequately fenced enclosures or buildings.
      2.   Large Livestock: The term "large livestock" shall include horses, mules, burros, donkeys and asses, llamas, alpacas, cows, ostriches, emus, and any other livestock of a similar nature or size.
      3.   Noise And Odor Control: "Adequate control over odors and noises emitted" shall mean such controls as are necessary to prevent odors and animal noises from being offensive to neighboring properties.
   D.   Penalties: Any person violating the provisions of this section shall be guilty of an infraction and, on conviction thereof, shall be subject to penalty as provided in section 1-4-1 of this code. (Ord. 352, 10-10-2002)
