A. Animals At Large Prohibited: No horses, mules, asses, cattle, swine, sheep or goats shall be allowed to run at large upon any of the streets, alleys or lanes within the corporate boundaries of the city at any time during the night or day. All such animals found running at large may be taken up and confined in the city pound by the designated animal control officer, and he shall furnish all such animals proper food and care while so confined. B. Notice Of Impoundment And Redemption:
1. In case any animal is taken up and confined in the city pound by the city police, the police shall, if the owner is known, notify said owner, either verbally or by written notice, that such animal has been taken up by said police and confined in the pound, which said notice shall be given immediately upon impounding such animal, and if said owner fails to pay such charges and redeem such animal within two (2) days from the time of service of said notice, then such animal may be sold by the city to the highest bidder for cash, after giving five (5) days' notice of such sale and by posting notices thereof in three (3) public places, stating the time, terms of sale and a description of the property to be sold and the place of the sale.
2. In case the owner is unknown, the city police shall, upon impounding any animal, post notices in three (3) public places of the city giving a description of same and that the same are confined in the city pound and that unless the owner appears and pays for the food, care, cost of impounding and posting of notices, that said animal will be sold at public auction for cash to the highest bidder, stating therein the time when, and the place where, such sale will be made by said police, but, no sale, in this case, shall be made until at least seven (7) days' notice shall be given by such posting, and a copy of such notice shall be published in one issue of a newspaper of general circulation in the city. C. Impounding Fee: The fees shall be as determined by the council to cover any costs in keeping and taking up the animal as well as other legal and administrative costs as may be deemed necessary. (1993 Code)
D. Penalties: In addition to the penalties herein prescribed, any person who allows any animal owned by him or under his care and charge to run at large in violation of this section shall be deemed guilty of a misdemeanor and, upon conviction thereof, shall be punished as provided in section 1-4-1 of this code.
