3-1-5: IMPOUNDING DOGS:
   A.   Impoundment: It shall be the duty of the tribal, BIA or city police officer or the city animal control officer or any suitable person under their direction to impound any dog running at large in violation of the provisions of this chapter and immediately notify the owner of such dog that such dog has been impounded and will not be held more than forty eight (48) hours before destruction. The owner thereof may redeem said dog within twenty four (24) hours of being notified by paying the city clerk the appropriate sum as set out in subsection D of this section.
   B.   Notification Of Impoundment:
      1.   Not later than twenty four (24) hours after any licensed dog with a tag has been apprehended or whose owner is otherwise known to the person taking up such dog, the owner shall be notified, and said owner will take possession of said dog after payment to the city clerk of the appropriate fee as set forth in subsection D of this section. If said owner cannot be found, the dog shall be impounded. Before any action is taken for the sale or destruction of such dog, such notice shall be given, in writing, served personally on the owner, or if personal service cannot be made, then such notice shall be sent to such owner by registered or certified mail, return receipt requested, to the then known address of such owner, or if unknown, to the address given by such owner on the license application form for the year immediately preceding impounding. Such owner shall be deemed to have received actual notice four (4) days following the day upon which such notice shall have been deposited in the mail, as provided in this section.
      2.   If the apprehended dog does not have a tag displayed, and the owner thereof is unknown, the dog shall be immediately destroyed in a humane manner after reasonable efforts have been made to determine the owner.
   C.   Reclaiming Of Impounded Dog: The owner of any dog so impounded may reclaim such dog upon the payment of all costs and charges incurred by the city impounding and maintaining such dog, the payment of the appropriate fine as set forth in this section and by signing an affidavit of ownership of said dog. Such affidavit shall contain a full description of the dog to include breed, sex, color, height and weight plus other information as shall be required by the city clerk.    D.   Impounding Fee: The fees to be charged in connection with the taking up and impounding of dogs running at large shall be set from time to time by resolution of the city council. (Ord. 329, 7-10-1997)
