4-1-6: WINTER STREET POLICY:
   A.   Parking:
      1.   It shall be illegal for any vehicle to be parked in such a manner so as to impede snow removal operations. Any vehicle left in the street or right of way may be subject to citation and/or removal, at the owner's expense. Owners may return vehicles to "on street" parking following the completion of the plowing operations.
      2.   Vehicles left in the right of way are left there at the owners risk and could be struck by a snowplow during plowing operations. In the event there is damage to a snowplow or other city equipment caused by vehicles left in the right of way, owners of said vehicle could be subject to reimbursing the City the cost of the damage. The City is not liable for damage to any privately owned vehicles, boats, trailers, etc. when parked in the city right of way.
   B.   Right of Way Encroachments: Mailboxes, newspaper boxes, fences, and other personal property located in the street right of way are the responsibility of the owner. Damage to personal property located in the city right of way resulting from plowing operations is not a reimbursable expense. Owners of personal property located in the City right of way could be subject to reimbursing the City should damage occur to City equipment during plowing operations.
   C.   Accumulations from private property: It is unlawful for any person to deposit or cause to be deposited, throw upon, or move onto any public street, sidewalk, thoroughfare or other public property including right of way, any snow, ice, dirt, soil, rock, or debris that has accumulated on any private property.
   D.   Sidewalks: Owners and occupants of privately owned premises shall be responsible for keeping their sidewalks and any areas adjacent to their business or premises or any portion of their real property, including corners, free and clear of snow and ice.
   E.   Penalty: Violation of this ordinance or any part thereof shall be an infraction subject to punishment to the maximum allowed by Idaho Code. (Ord. 462, 10-8-2020)
