For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
CITY. The City of Plentywood, Sheridan County, Montana.
OWNER. Unless otherwise indicated, an OWNER is a person, party or entity having a legal ownership interest in real property based upon the records or information in the office of the County Clerk and Recorder along with records or files in other offices of the county or the state. The word OWNER includes ownership by a single party, person or entity, or ownership by multiple parties, persons or entities. For pending contracts for deed not declared on public record to be in default, the purchasing party or buyer shall be regarded as the OWNER. Where property has been repossessed or foreclosed upon by a seller or lender, the seller or lender is regarded as the OWNER. When property is held in trust, according to the records of the county or the state, the trustee is regarded as the OWNER or responsible party and the party to whom notice should be directed. If the OWNER of property is deceased, incompetent or the subject of a conservatorship or guardianship proceedings, the owner’s personal representative, guardian, conservator or other acting fiduciary, according to public records of the county or the state, will be regarded as the OWNER or responsible party and the one to whom notice will be given.
PENALTIES FOR DELINQUENT UTILITY CHARGES. The term PENALTIES, when referring to delinquent utility bills, includes any additional charge imposed or incurred as the result of not paying for utilities by the due date such as “late” fees or charges.
UTILITY or UTILITIES. Water, sewer and/or garbage collection services, or any of them, provided or furnished by the city.
