§ 33.02 CHIEF OF POLICE.
   (A)   Appointment. The Mayor shall appoint, with the approval of the Council, a chief of police who shall hold office for the duration of his or her appointment or until such time as the Chief may be removed by the Mayor with the consent of the Council.
   (B)   Duties. It is the duty of the Chief of Police:
      (1)   To execute and return all processes issued by the City Court Judge or directed to the Chief by any legal authority and to attend the city court regularly;
      (2)   To arrest all persons guilty of a breach of the peace or for the violation of any city ordinance and bring them before the City Court Judge for trial;
      (3)   To have charge and control of all police officers of the city, subject to such rules as may be prescribed by ordinance, the Mayor or Council, and to report to the Mayor and Council all delinquencies or neglect of duty or official misconduct of police officers for action by the Mayor and/or Council;
      (4)   To preserve the peace and good order of the city; and
      (5)   To perform such other duties as the Mayor or Council may prescribe.
   (C)   Powers of constable. The Chief of Police has the same powers as a constable in the discharge of the Chief’s duties, except that the Chief shall not serve a process in any civil action or proceeding unless the city is a party.
