§ 153.242 DWELLINGS AS NON-CONFORMING USES.
   Regardless of any other provision of this chapter, the following applies to dwellings classified as “non-conforming” where such use as dwellings is not permitted within the district following the effective date of the adoption of the original zoning ordinances or the adoption of subsequent zoning amendments or reclassifications.
   (A)   An accessory building or structure may be placed or constructed by permit to serve as an incidental or subordinate use to a dwelling that is a non-conforming use or structure.
   (B)   A non-conforming dwelling that is destroyed totally or partially by fire, natural disaster or other cause unintended by the owner may be reconstructed, replaced or rebuilt by permit as a dwelling. By being reconstructed, replaced or rebuilt, the dwelling does not lose its status as an allowed non-conforming use or structure.
   (C)   A dwelling may be enlarged or expanded by permit beyond its originally non-conforming size or area, as long as the enlargement or expansion is not otherwise in violation of any setbacks or other zoning regulations.
