§ 153.222 DISCRETION IN GRANTING EXCEPTION AND APPEAL.
   (A)   The decision whether an accessory structure is permitted on a lot not having a structure with a bona fide principal use is within the discretion of the City Council to be based on the criteria provided above.
   (B)   As an issue involving the “use” of property, the Council’s decision, in granting or denying the requested exception, is not subject to appeal to the Board of Adjustments for a variance.
   (C)   Any related or incidental issues not involving this question of use, such as setback distances or other matters of measurement, are subject to appeal to the Board.
