§ 151.026 DEFINITIONS.
   For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   EXCAVATION. Any excavating, digging or opening up, including, but not limited to, such things as EXCAVATIONS for connecting, installing, repairing, replacing, removing, placing or locating a water or sewer main, service line, pipe or other conduit; electrical, telephone, telecommunications, transmission or cable television lines; for providing, maintaining or locating any other utility service or apparatus; or an excavation for any other useful, reasonable and lawful purpose.
   PUBLICLY DEDICATED. A place shall be regarded as PUBLICLY DEDICATED when shown to be dedicated for the use of the public according to instruments or records filed with the County Clerk and Recorder.
   PUBLICLY DEDICATED PLACE. Includes any street, road, alley, right-of-way or other place that is dedicated for the use of the public.
