§ 111.01 DEFINITIONS.
   For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   ALCOHOL. Ethyl alcohol, also called ethanol, or the hydrated oxide of ethyl.
   ALCOHOLIC BEVERAGE. A compound produced and sold for human consumption as a drink that contains more than 0.5% of alcohol by volume. ALCOHOLIC BEVERAGES shall include any form of alcohol, whether defined as LIQUOR, BEER, WINE or some other generic type classification.
   BEER. A malt beverage containing not more than 7% of alcohol by weight.
   CONTAINER. Any sort of device that is capable of holding or containing fluids.
   LIQUOR. An alcoholic beverage, except beer and table wine.
   MALT BEVERAGE. An alcoholic beverage made by the fermentation of an infusion or decoction, or combination of both, in potable brewing water, of malted barley with or without hops or their parts or their products and with or without other malted cereals and with or without the addition of unmalted or prepared cereals, other carbohydrates or products prepared from carbohydrates and with or without other wholesome products suitable for human food consumption.
   MOTOR VEHICLE. A vehicle propelled by its own power and designed or used to transport persons or property upon roadways or elsewhere.
   OPEN CONTAINER. A container that is not closed or sealed so that when inverted, any fluid therein will readily flow out of the container without the removal of any seal, cap, cover or other device holding such fluid inside such container. Means a glass, mug, cup or other such similar device used for holding and/or drinking beverages; a bottle or other such similar device made of glass, plastic or other material that is not corked, capped, sealed or similarly closed to prevent spillage or consumption of the beverage therein; a can or other such similar device made of metal or other material that has been opened so that it no longer has its original seal and from which a person can readily consume any beverage therein.
   PUBLIC DISPLAY OR EXHIBITION OF AN ALCOHOLIC BEVERAGE. The carrying, possession and/or exhibiting of an open container of an alcoholic beverage:
      (1)   In, on or within a public place within the city; or
      (2)   In, on or within a motor vehicle parked, standing or driving upon a public place.
   PUBLIC DRINKING. The drinking or consuming of an alcoholic beverage in, on or within a public place within the city, including, but not limited to, such drinking or consuming conducted within a motor vehicle that is parked or traveling in, on or within a public place.
   PUBLIC PLACES. All streets, roadways, alleys, sidewalks, parking lots or unenclosed parking spaces located within the city. The term does not include premises licensed to sell alcoholic beverages.
   TABLE WINE. Wine that contains not more than 16% alcohol by volume and includes cider.
   VEHICLE. Every device in, upon or by which any person or property may be transported or drawn upon a roadway or elsewhere, except devices moved by animal power or used exclusively upon stationary rails or tracks.
   WINE.
      (1)   An alcoholic beverage made from or containing the normal alcoholic fermentation of the juice of sound, ripe fruit or other agricultural products without addition or abstraction, except as may occur in the usual cellar treatment of clarifying and aging, and that contains more than 0.5% but not more than 24% of alcohol by volume.
      (2)   WINE may be ameliorated to correct natural deficiencies, sweetened and fortified in accordance with applicable federal regulations and the customs and practices of the industry. Other alcoholic beverages not defined in this definition but made in the manner of wine and labeled and sold as wine in accordance with federal regulations are also WINE and shall be considered WINE.
