ORDINANCE NO. 2020-6
AN ORDINANCE AMENDING TITLE 8 “UTILITIES” CHAPTER 8 “PRESSURIZED IRRIGATION” SECTION 33 “WATER METERS” OF THE PLEASANT GROVE MUNICIPAL CODE; REQUIRING NEW CONSTRUCTION TO INSTALL PRESSURIZED IRRIGATION WATER METERS AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Utah State Code grants municipalities the power to regulate municipal pressurized irrigation water systems; and
WHEREAS, Pleasant Grove City has previously adopted regulations regarding its pressurized irrigation water system; and
WHEREAS, Pleasant Grove City does not currently require pressurized irrigation connections to be metered;
WHEREAS, the Utah State Legislature has recently adopted regulations requiring new to secondary water connections to be metered; and
WHEREAS, Pleasant Grove City desires to be in compliance with the state regulations; and
WHEREAS, Pleasant Grove City desires to adopt regulations regarding the metering requirement.
NOW, THEREFORE, BE IT ORDAINED by the City Council of Pleasant Grove City, Utah County, State of Utah as follows:
Title 8 Chapter 8 Subsection 33 “Water Meters” shall be amended to read:
8-8-33: WATER METERS:
Water meters shall not be installed at each pressurized irrigation water connection; provided, however that the council may determine that it is necessary to monitor water use through any pressurized irrigation water connection or combination of pressurized irrigation water connections. (Ord. 2005-39, 12-6-2005)
After July 1, 2020,a water meter shall be installed at each new pressurized irrigation water connection.Meters shall be installed per the city’s adopted standard details and specifications. Pressure irrigation water meters must be installed before occupancy will be granted for any new structure where the property has a pressure irrigation connection.The city may install meters at preexisting connections at any time as part of a planned meter installation program.
After installation of the meter by the city, at no time shall anyone be allowed to open or access the meter box unless under direction of the city.
A separate service connection and water meter must be provided for each parcel or lot to be connected to the pressure irrigation system. The City Engineer may approve other layouts due to preexisting or atypical conditions. Before water will be supplied through the connection, some person or legal entity shall agree to be responsible for and pay for all water used through the service.
Where water is now supplied through one service, to one or more houses or persons, the City Engineer may, in his discretion, either refuse to furnish water until separate services are provided or may continue to supply on condition that one person shall be responsible for and pay for all water used through the service.
SECTION 2. SEVERABILITY. The sections, paragraphs, sentences, clauses, and phrases of this Ordinance are severable. If any such section, paragraph, sentence, clause, or phrase shall be declared invalid or unconstitutional by the valid judgment or decree of a Court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of any of the remaining sections, paragraphs, sentences, clauses or phases of this Ordinance.
SECTION 3 . EFFECTIVE DATE. This ordinance shall take effect immediately upon its passage and posting as provided by law.
SECTION 4. APPROVED AND ADOPTED by the City Council of Pleasant Grove City, Utah County, Utah, this 23rd day of _June, 2020.
