§ 114.30 RESTRICTIONS OF RETAIL MALT BEVERAGE LICENSEES.
   (A)   No malt beverage retailer licensee licensed under SDCL § 35-4-2(16) may sell, serve or allow to be consumed on the premises covered by the license, any malt beverage between the hours of 2:00 a.m. and 7:00 a.m. of any day.
   (B)   All premises covered by license for retail malt beverage sales shall be vacated by all persons including customers and employees no later that one-half hour after the sale of malt beverages is prohibited.
   (C)   No malt beverage retail licensee licensed under SDCL § 35-4-2(16) shall permit any person less than 21 years of age to sell, serve or dispense malt beverages on the licensed premises unless such sales of malt beverages constitute less than 50% of the gross business transacted by the establishment on an annual basis and the licensee or an employee that is at least 21 years old is on the premises when such sale is made.
