§ 92.24 DISCRETIONARY EXCEPTION.
   (A)   (1)   Landowners within the city limits may apply for a discretionary exception to this subchapter for the purpose of haying by filing a written application requesting a discretionary exception with the Finance Officer.
      (2)   Said application shall contain the legal description of the real property for which the landowner is requesting the exception.
      (3)   The Finance Officer shall schedule the application for public hearing and shall give at least ten days’ notice of said public hearing by publication.
   (B)   The City Council may grant or deny the application after consideration of the following factors:
      (1)   Proximity of the real estate to the city limits;
      (2)   Proximity of the real estate to existing commercial and residential structures;
      (3)   Size and character of parcel;
      (4)   Comments from individuals attending the public hearing; and
      (5)   Such other factors as may be deemed relevant under the facts and circumstances of each individual application.
   (C)   If the application is approved, the discretionary exception may be granted for a term of up to five years, after which period of time, the landowners may reapply.
