(A) Generally. Any person violating any provision of this chapter, for which no other penalty is provided, shall be subject to the penalty provisions of § 10.99. (B) General provisions. Any person violating any provisions of §§ 131.01 through 131.05 or any order made by the President of the Town Council, in accordance with the term of §§ 131.01 through 131.05 shall be punished by a fine of not more than $100. (1) Persons violating the provisions of §§ 131.20 through 131.23 shall be subject to a civil fine of not less than $100 and not more than $1,000, plus court costs. Each day of the existence of any violation of §§ 131.20 through 131.23 shall be considered a separate offense. (2) Entities, including businesses and retail establishments, violating the provisions of §§ 131.20 through 131.23 shall be subject to a civil fine of not less than $250 and not more than $2,500, plus court costs. Each day of the existence of any violation of §§ 131.20 through 131.23 shall be considered a separate offense. (1) A person who smokes in an area where smoking is prohibited by the provisions of §§ 131.35 through 131.47 shall be guilty of an infraction, punishable by a fine not exceeding $50. (2) A person who owns, manages, operates or otherwise controls a public place or place of employment and who fails to comply with the provisions of §§ 131.35 through 131.47 shall be guilty of an infraction, punishable by: (a) A fine not exceeding $100 for a first violation;
(b) A fine not exceeding $200 for a second violation within one year; and
(c) A fine not exceeding $500 for each additional violation within one year.
