(A) The definitions set forth in I.C. 6-3.5-10-1 are incorporated herein and shall apply throughout this section.
(B) (1) Effective January 1, 2023, the following vehicles, registered in the town and subject to the motor vehicle license excise tax shall be subject a surtax in the amount of $25, in accordance with the provisions of I.C. 6-3.5-10 et seq. The surtax shall apply to the following vehicles:
(a) Passenger motor vehicles ;
(b) Motorcycles;
(c) Motor driven cycles;
(d) Collector vehicles;
(e) Trailer vehicles with a declared gross weight of 9,000 pounds or less;
(f) Trucks with a declared gross weight of 11,000 pounds or less;
(g) Mini-trucks; and
(h) Military vehicles.
(2) The surtax shall be paid with the registration of each such vehicle. The town's Clerk-Treasurer shall deposit revenue received from the surtax in a fund to be known as the "Plainfield Surtax Fund" and shall distribute the Surtax Fund in accordance with I.C. 6-3.5-10-10.
(3) Notwithstanding the foregoing, for the calendar year commencing on January 1, 2023 only (the “Initial Year”), the surtax shall not apply to the registration of a vehicle for the registration year that commenced in the calendar year preceding the initial year.
(C) The “Plainfield Surtax Fund” is hereby created and shall be a non-reverting fund. The town may use the surtax revenues (1) to construct, reconstruct, repair or maintain streets and roads under the town's jurisdiction; or (2) for the town's contribution toward a grant from the local road and bridge matching grant fund under I.C. 8-23-30.
(D) On or before October 1 of each year, the town's Clerk-Treasurer shall provide the Town Council with an estimate of the surtax revenues to be received by the town during the next calendar year. The town shall include the estimated surtax revenues in the town's budget estimate for the calendar year.
(E) The Town Council hereby authorizes the Town Manager or his designee to send a copy of this section to the Indiana Bureau of Motor Vehicles as required by I.C. 6-3.5-10-6.
(F) This section shall be in full force and effective from and upon its adoption and in accordance with Indiana law.
