(A) Except as otherwise provided herein, the Town Council (“Council”) shall administer, implement, and enforce the provisions of this chapter. Any powers granted to or duties imposed upon the Council or the Superintendent may be delegated to other Town personnel or qualified contractors.
(B) The town will maintain sufficient resources and qualified personnel to carry out the non-delegated pretreatment program in accordance with 327 I.A.C. 5-19-3.
(C) If any provision of this chapter is invalidated by any court of competent jurisdiction, the remaining provisions shall not be affected and shall continue in full force and effect.
