A. Engineer Approval Required: No ditch, drain or other waterway through which ground or surface waters from any source whatsoever collects or passes shall be piped, culverted or in any manner filled in without the approval of the city engineer. This includes ditches which are presently piped or otherwise enclosed which may be opened for any purpose.
B. Conformance: The project shall be completed under the direction of the city engineer and shall conform to all specifications that the city engineer shall establish.
C. Permit Required: Before any person places piping, culverts, or in any manner fills in any said ditches, drains or waterways, he shall obtain a permit from the city recorder. (1982 Code § 9-526)
D. Fee For Permit: The city recorder shall collect a fee for the permit in such amount as established by resolution of the city council, which amount may be changed by resolution at the discretion of the city council.
E. Penalty: Any person who violates this section shall be guilty of a class B misdemeanor, subject to penalty as provided in section 1-4-1 of this code. (1982 Code § 9-526; amd. 2003 Code)
